Asbestos Legal Matters

After a long and arduous battle, asbestos legal measures resulted in the partial ban in 1989 of the production, processing and distribution of a majority of asbestos-containing products. The ban is still in effect.

The final TSCA risk assessment of chrysotile revealed unjustifiable health risks in all current applications of chrysotile. The April 2019 rule bans the return of these asbestos products for sale.

Legislation

Asbestos laws are controlled at the federal and state levels in the United States. While many industrialized countries have banned asbestos, the US continues to use asbestos in a variety of different products. The federal government regulates how it is used in these various products and regulates asbestos litigation and abatement. State asbestos laws may differ between states even though federal laws are generally uniform. These laws typically restrict claims made by those who have suffered from exposure to asbestos.

Asbestos occurs naturally. It is mined from the ground usually using open-pit mining techniques and is composed of fibrous strands. These strands undergo processing and are mixed with cement or another binding agent to create asbestos-containing material (ACM). New Jersey requires all abatement companies to have a license issued by the Department of Labor and Workplace Development and all employees to have supervisor or worker permits.

Litigation

Asbest cases flooded state courts as well as federal courts in the late 1970s and into the early 1980s.
